The 2nd U.S. Circuit Court of Appeals has ruled that lie-detector tests can be used to ensuresex offenders are obeying probation and that a ban on Web use is appropriate for some offenders.The ruling pertained to Jeffrey Johnson, an aerospace engineer who had used the Web to conductsexually explicit conversations with children from 1995-1997. He received more than seven years inprison and three years’ probation after admitting to luring several kids to meetings and having sexwith two victims. He challenged the use of polygraph testing on constitutional grounds

State Senator Carl Kruger (D-Brooklyn) vowed to step up efforts to make any sex between educators and students illegal, even if the student is old enough to consent.  What does ‘consensual’ mean to a 17 year old when her teacher is telling her ‘I’m going to fail you unless you do X, Y, Z?’ said Kruger.  The bill is currently in committee, but now that the state budget is almost done, Kruger plans to renew his push with Chancellor Joel Klein’s backing.

A state appeals court bolstered Governor George Pataki’s effort to confine sex offenders who have served their sentences by ruling that 12 sex offenders he ordered moved from prison to mental hospitals last fall had been properly committed and did not have their constitutional rights violated.  Pataki hailed the decision.  We knew from the beginning that there are no special rights for sexual predators, despite what the lower court said, Pataki said.

Putnam County legislators have approved a bill to limit where convicted sex offenders can go.  The measure, passed Tuesday night, still must be signed by the county executive.  It would bar offenders from living, working or spending time within 2,500 feet of places where children congregate, including schools, bus stops, child-care facilities, nature preserves, parks, playgrounds and recreational facilities.  Also off limits would be multifamily residences and housing developments with 10 or more homes on less than a third of an acre.

While supported by victims’ rights advocates and Governor George Pataki, civil confinement measures have failed to pass in the Democrat-led Assembly, in part because of concerns about the civil rights of sex offenders who already have served their time.  But this year the Assembly has introduced its own civil commitment bill to rival the one proposed by Senate Republicans.  Both are part of a slew of sex offender-related legislation introduced against a backdrop of recent high profile sex crimes.  Significant differences between the bills remained after both sides met last
