CHILD RAPE CASE AGAINST FORMER CHICKASAW ALABAMA POLICE OFFICER BOB INGLE MAY DISAPPEAR AFTER HIS VICTIM DIES IN TRAFFIC ACCIDENT
News
Eleven year old Rebecca McEvoy died in a traffic accident three months ago. Family members andsupporters want the man accused of raping her, former Chickasaw Police Officer, Bob Ingle, behindbars. But at a hearing Wednesday the defense brought up a case called 'Crawford out of Ohio,' whereyou have the constitutional right to cross examine your accuser and in this case she's dead. Shecan't testify and there is a chance they may throw it out because she can't be cross examined.Assistant District Attorney Steven Giardini explained, Their point is, according to the SupremeCourt, this statute or exception to the hearsay rule would no longer apply if the defense has noopportunity to cross examine the victim. Family members say that before Rebecca died she underwenta medical examination, and had a taped interview with police about what transpired and they believethat should be enough to convict Ingle. A hearing is rescheduled for April 22nd.
