Robert McKelvey, pleaded guilty in November 1998 to a single count of possession of childrnpornography. McKelvey, 28 years old at the time, was a second year student at DartmouthrnMedical School in 1994 when the investigation began. He had been studying to be arnpediatrician. The college eventually expelled him after someone reported seeing him with a 9rnyear old boy in a locker room in the College gym in March 1994. While he worked as arnvolunteer in a big brother-little brother program, he made child pornography of a young boy.rn
The 1st U.S. circuit Court of Appeals overturned the conviction saying possession of threernphotographic negatives wasn't illegal.rn
