COURT OVERTURNS CHILD PORNOGRAPHY CONVICTION OF ST. LOUIS MAN

Robert McKelvey, pleaded guilty in November 1998 to a single count of possession of childpornography.  McKelvey, 28 years old at the time, was a second year student at DartmouthMedical School in 1994 when the investigation began.  He had been studying to be apediatrician.  The college eventually expelled him after someone reported seeing him with a 9year old boy in a locker room in the College gym in March 1994.  While he worked as avolunteer in a big brother-little brother program, he made child pornography of a young boy.
The 1st U.S. circuit Court of Appeals overturned the conviction saying possession of threephotographic negatives wasn't illegal.
