WORCESTER -- A Gardner podiatrist faces charges for allegedly writing a Florida man fraudulent prescriptions with no legitimate medical reason for a known date-rape drug, authorities said Monday.

 

The podiatrist, 64-year-old Richard E. Genovese of Rindge, New Hampshire, was arraigned in Worcester Superior Court on Friday, where he pleaded not guilty to 10 counts of unlawfully prescribing a class A drug and one count of conspiracy to violate the Controlled Substances Act. Genovese pleaded not guilty, according to a Monday press release from the office of Massachusetts Attorney General Maura Healey.  Following a joint investigation with the Drug Enforcement Administration, Healey alleged that Genovese, as a podiatrist, wrote 10 orders of Xyrem for 45-year-old Eric Boulianne of Boca Raton, Florida. Xyrem contains GHB, a class A controlled substance used to treat narcolepsy that authorities say is also used illegally as a date-rape drug.

 

In April 2014, when Boulianne was facing a separate criminal case in Canada for possessing GHB, Genovese allegedly wrote to an attorney claiming that he gave Boulianne prescriptions for a legitimate medical reason, according to Healey's press release. However, investigators allegedly found "no evidence that Genovese ever provided medical treatment to Boulianne and, moreover, no evidence that he provided any treatment requiring the use of Xyrem," the Monday press release stated.

 

Genovese was indicted on Sept. 13.  Boulianne also faces charges in Worcester Superior Court. He was arraigned on Oct.  31 and pleaded not guilty to one count of conspiracy to violate the Controlled Substances Act.

Both men were released on personal recognizance at the orders of Judge Janet Kenton-Walker. They will next appear in court on Feb. 1, 2019.
