A Greene County man was sentenced Friday to 12 years in prison after he was caught in the act of sexually abusing a teenage girl.
Emmett Duty, 40, was sentenced as part of a plea agreement he signed with prosecutors in exchange for admitting he was guilty of two counts of child molestation.
According to a probable cause statement in the case, deputies were called out to a Greene County home late on Sept. 26, 2019, after a family member said she walked in on Duty sexually abusing a girl.
The statement says the girl indicated this was not the first time she had been abused by Duty.
In an interview with a detective, court documents say Duty blamed the child for initiating the sexual contact. Under Missouri law, children cannot consent to sex with adults.
Court documents say Duty has a history of similar behavior. He was convicted in 2005 of statutory rape involving a 14-year-old victim. In that case, he was sentenced to some prison time and required to register as a sex offender.
As part of Duty's plea agreement in the 2019 Greene County case, Duty's attorney was allowed to argue for probation at a hearing on Friday.
At Friday's hearing, the victim's mother said she and her daughter have been incredibly hurt by Duty's actions. She urged Judge Thomas Mountjoy to deny the request for probation and send Duty to prison on the 12-year sentence.
"He does not deserve mercy or the chance to hunt again," the victim's mother said.
Assistant Greene County Prosecutor Stephanie Wan also asked for the prison time, saying Duty is a repeat offender who has not taken responsibility for his actions.
Duty's attorney Samuel Reed argued that with the proper treatment, Duty could safely be in the public and act as a contributing member of society.
Ultimately, Judge Thomas Mountjoy denied the request for probation and sentenced Duty to 12 years in prison.
"You are a predator," Mountjoy said. "Everything in this case says you are a predator. Probation is not even close to consideration."
