TEACHER ADMITS TO IN CLASSROOM SEX WITH STUDENT RECEIVED FELONY CHARGE

Emily Nesbit, a 31 year old English teacher, resigned her position in the wake ofallegations of sex with an 18 year old student and a felony charge related to the act.  She isaccused of having sex with the student on school property.  Reportedly in the classroom. The student is of the legal age of consent, in the state of Pennsylvania, but the act performed onschool property, plays a role in the charges.  Nesbit was charged with institutional sexassault, a third degree felony.  If convicted she could face up to seven years in prison.
According to Pennsylvania state law, Institutional sexual assault is defined as a person whois an employee or agent of the Department of Corrections or a county correctional authority, youthdevelopment center, youth forestry camp, state or county juvenile detention facility, otherlicensed residential facility serving children and youth, or mental health or mental retardationfacility or institution commits a felony of the third-degree when that person engages in sexualintercourse, deviate sexual intercourse or indecent contact with an inmate, detainee, patient orresident.
The teacher-student affair was reported after a female student discovered sexual textmessages on the alleged victim's phone.
Nesbit's attorney state that she intends to accept responsibility in court and continue towork on her personal issues that lead to the alleged inappropriate conduct.
