EX-MARINE SENTENCED IN CHILD ABDUCTION

Former US Marine Toby Studabaker, 32, who took a 12 year old girl on a European jaunt, told a German court at his arraignment on abduction charges that he did not have sex with her.  Studabaker said he would not contest extradition to Britain and insisted he thought English schoolgirl Shevaun Pennington, who left her home to travel to France with him in July 2003, was 18.  After he called the FBI on his phone, cops were able to track his movements and nabbed him outside the US Consulate in Frankfurt, where, cops believe, he intended to turn himself in to American authorities.

Studabaker pleaded guilty to abducting the girl and was sentenced to 4 1/2 years in prison.  He also admitted incitement to gross indecency with the girl.
