SUFFOLK DA DROPS CHARGE

Daniel Toy, 38, was accused of showing an 8 year old girl pornographic pictures and movies and sexually abusing her over a period of months.  A Riverhead jury acquitted the Westhampton man of raping, sodomizing and sexually abusing the girl.  According to Newsday, the acquittal came even though he signed four confessions detailing the alleged acts.  However, the girl testified that she could not recall many sexual contact with him.  She only remembered him showing her the porn images.  A psychiatric expert testified it is not unusual for a child to block out memories of sex abuse.  Now the Suffolk prosecutors have dropped the last remaining count against him, the charge of endangering the welfare of a child.  The charge was dropped at the discretion of the Suffolk district attorney's office.  They said they opted not to pursue the charge in order to protect her and her brother, who would have been a witness in the case.  He faced up to a 1 year prison sentence for child endangerment and 20 years if convicted of the more serious felony charges.
