A state appeals court has ruled that sex offenders who show that they can adhere to restrictions that would substantially reduce the risk of their committing further offenses can be authorized for release.  The ruling stems from a suit filed by a 68 year old man who was involuntarily committed to further custody after completing two prison terms for molesting young boys.  Although the decision, which was issued last week, did not order the man’s release, it did return the case to trial court.

Joseph Gibbs, 49, was arrested yesterday in the sexual abuse of a friend’s 8 year old daughter in Brownsville last month.  On November 12, Gibbs was babysitting the girl while her mother, a friend, was away from her apartment when the alleged abuse occurred.  Gibbs was charged with sexual abuse and endangering the welfare of a child after police were called to the hospital and the girl reported the incident.

Governor Pataki want to include the photos, descriptions and victim patterns of up to 50 times more sex offenders on a state Web site so the public can more readily identify offenders in their neighborhoods.  Another proposal released by Pataki yesterday would provide for the arrest of convicted sex offenders if they fail to report their address to authorities each year, even if they don’t move.  He said the proposals would strengthen the ability of law-enforcement agencies to keep track of sex offenders and provide the information to the public
